The Rent Increase Limit Application has been extended.

With the legislative amendment published in the Official Gazette, the application of the "25% rent increase limit" in residential rents has been extended. The temporary provision added to the law covers the period from 02.07.2023 to 01.07.2024. If landlords increase the rent beyond the 25% limit, the excess amount will be invalid, and the landlord will not be able to request the tenant's eviction due to the non-payment of the increase above this limit. The relevant regulation is as follows:
"In accordance with Article 23 of the Law on the Imposition of Additional Motor Vehicle Tax for Compensating the Economic Losses Caused by Earthquakes Occurred on 2/6/2023 and Making Amendments to Certain Laws and Decree Law No. 375, published in Official Gazette No. 32249 on 15 July 2023, the following temporary provision has been added to the Turkish Code of Obligations No. 6098.
"TEMPORARY PROVISION 2 - Agreements regarding the rental amount to be applied during the renewed rental periods between 2/7/2023 and 1/7/2024 (including these dates) are valid, provided that they do not exceed 25% of the rental amount of the previous rental year. If the rate of change according to the twelve-month average of the consumer price index of the previous rental year remains below 25%, the rate of change is valid. This rule also applies to lease agreements longer than one year. Agreements made exceeding these rates are invalid in terms of the excess amount. This provision also applies to decisions to be rendered by the judge in accordance with the second paragraph of Article 344."
